Terms of Service

1. Acceptance of Terms

By accessing or using Base44 ("Platform", "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you and Base44. If you do not agree, you must immediately stop using the Platform.

You must be at least 13 years of age to use this Platform. Users between 13–17 must have parental or guardian consent. Users must be at least 18 to purchase digital products or access certain age-restricted features.

2. Eligibility & Account Registration

To use the Platform, you must:

• Be at least 13 years of age (or have verifiable parental consent)
• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your login credentials confidential and secure
• Notify us immediately of any unauthorized account access at privacy@base44.app
• Hold only one account per person — duplicate accounts may be terminated

You are solely responsible for all activities that occur under your account.

3. Acceptable Use Policy

You agree not to use the Platform to:

• Post, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, or obscene
• Post content that exploits or harms minors in any way
• Impersonate any person, entity, or organisation
• Distribute spam, phishing, malware, or unsolicited commercial messages
• Scrape, crawl, index, or systematically collect data from the Platform without written permission
• Attempt to gain unauthorized access to other accounts, systems, or networks
• Post content that infringes copyright, trademark, or other intellectual property rights
• Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law
• Sell, transfer, or license your account to any third party
• Interfere with or disrupt the integrity or performance of the Platform
• Use automated bots or scripts to interact with the Platform without prior written consent

Violations may result in immediate account suspension or permanent termination, at our sole discretion.

4. User-Generated Content & Intellectual Property

You retain full ownership of all content you create and post on the Platform. By posting content, you grant Base44 a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, display, distribute, and adapt your content solely for the purpose of operating and promoting the Platform.

You represent and warrant that:

• You own or have the right to post the content
• Your content does not infringe any third-party rights
• Your content complies with these Terms and all applicable laws

Base44 respects intellectual property rights. To submit a DMCA/copyright takedown notice, email legal@base44.app with the required information under 17 U.S.C. § 512(c).

5. Content Moderation & Enforcement

We reserve the right, but are not obligated, to monitor, review, remove, or restrict access to any content that violates these Terms or that we reasonably believe is harmful to users or the Platform. Actions we may take include:

• Warning or temporary suspension of accounts
• Permanent account termination for severe or repeated violations
• Reporting illegal content to appropriate law enforcement authorities

We operate a good-faith appeals process. To appeal a moderation decision, contact support@base44.app within 30 days of the action.

6. Digital Products & Payments

The Platform may allow creators to sell digital products. All purchases are final unless required otherwise by applicable consumer protection law. Payment processing is handled by third-party providers. We are not responsible for payment processor errors or disputes. Creators are solely responsible for the accuracy of their product listings and fulfilling digital deliveries.

EU/EEA consumers have a 14-day statutory right of withdrawal on digital content purchases unless they have expressly consented to immediate delivery and acknowledged losing the right of withdrawal.

7. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with applicable data protection laws including GDPR, UK GDPR, CCPA, PIPEDA, and other applicable regulations.

8. Account Termination

You may delete your account at any time through Account Settings. Upon termination:

• Your profile and content will be removed within 30 days
• Backup copies are purged within 90 days
• Certain records may be retained as required by law (e.g., financial records, legal compliance logs)

We may suspend or terminate your account immediately and without notice for material violations of these Terms, fraudulent activity, or illegal conduct.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BASE44 AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Note for EU/EEA consumers: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable mandatory consumer protection law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Base44 and its affiliates, officers, agents, and employees from any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your user-generated content.

12. Dispute Resolution

We encourage users to contact us first to resolve disputes informally at support@base44.app. If informal resolution fails:

• US users: Disputes shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules, on an individual basis. CLASS ACTION WAIVER: You waive the right to participate in a class action lawsuit or class-wide arbitration.
• EU/EEA consumers: You may bring disputes before your local courts or the European Commission Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
• UK consumers: You retain the right to bring proceedings in the courts of England and Wales or your local courts
• Canadian users: Disputes shall be resolved under the laws of the applicable Canadian province

13. Governing Law

These Terms are governed by applicable law. For EU/EEA/UK consumers, mandatory local consumer protection laws of your country of residence apply and cannot be overridden by these Terms. Nothing in these Terms affects your statutory rights as a consumer.

14. Minor Safety & KOSA Compliance

OurSpace 2.0 takes the safety of minors seriously and complies with all applicable minor safety laws including COPPA and the Kids Online Safety Act (KOSA) framework:

• Users under 18 may not access OurSpace Connect (dating features) under any circumstances
• No targeted advertising is directed at users under 18
• Default minor accounts are configured with the most restrictive privacy settings
• We do not engage in engagement-maximization techniques designed to exploit minors
• Parents/guardians may request account deletion for minors by contacting privacy@ourspace.app

15. FTC & Advertising Disclosures

All commercial content, sponsored posts, and creator promotions on OurSpace 2.0 must comply with FTC Endorsement Guidelines (16 C.F.R. Part 255):

• Sponsored or paid content must be clearly labeled with #ad, #sponsored, or equivalent disclosure
• Creators are solely responsible for their own FTC disclosure obligations
• OurSpace 2.0 does not engage in deceptive advertising or misleading commercial practices
• Platform incentives (Aura points, referral bonuses) are disclosed transparently in-app

16. EU Digital Services Act (DSA)

OurSpace 2.0 complies with the EU Digital Services Act (Regulation (EU) 2022/2065) for users in the EU/EEA:

• Illegal content may be reported via the in-app Report function or at legal@ourspace.app
• All moderation decisions are subject to our transparent appeals process (contact support@ourspace.app within 30 days)
• Algorithmic recommendation systems are user-controlled — you may disable discovery mode at any time
• We do not use sensitive personal data categories for recommender system profiling

17. Accessibility (ADA / WCAG 2.1)

OurSpace 2.0 is designed to meet WCAG 2.1 Level AA accessibility standards. We provide Calm Space mode, reduced motion support, minimum 44px touch targets, and screen-reader-compatible markup. To report an accessibility issue, contact accessibility@ourspace.app.

18. App Store Additional Terms

If you access the Platform through Apple App Store or Google Play, the following additional terms apply:

• These Terms are between you and Base44 only, not with Apple or Google
• Apple and Google are not responsible for the Platform or its content
• Apple and Google are third-party beneficiaries of these Terms and may enforce them against you
• In-app purchases are subject to the respective app store's payment terms

19. Changes to These Terms

We may modify these Terms at any time. We will provide at least 30 days notice of material changes via in-app notification and/or email. Your continued use of the Platform after the effective date of changes constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the Platform and may delete your account.

20. General Provisions

• Severability: If any provision is found unenforceable, the remaining provisions remain in full force
• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Base44
• No Waiver: Failure to enforce any provision does not constitute a waiver
• Assignment: We may assign these Terms to a successor entity. You may not assign your rights without our written consent
